PPL Montana v. State of Montana

INTRODUCTION:

The State of Montana brought this case to confirm the navigability of the UPPER Missouri, Clark’s Fork and Madison Rivers.  The Montana Supreme Court ruled in Montana’s favor and the case is on appeal to the U.S. Supreme Court.  Many observers believe the Court will use this case to clarify how navigability is determined.  The Coalition joined with several other conservation groups in filing a friend-of-the-court brief supporting Montana’s position.
