• WHAT THE BILL DOES

It restores historical public uses of streams that are capable of floating cut timber or that can be navigated by recreational boats during ordinary high water.

It allows wading, walking and fishing in the stream corridor below the ordinary high water mark.

It continues to prohibit the public from crossing private land to reach a stream that is open to public use.

• WHAT THE LANDOWNERS GET

Protection for small streams. These will remain closed to public use.

No loss of title to the streambed for streams open to public use.

Protection from liability, trespass, vandalism and litter. No loss of exclusivity nor loss in property value.

• WHAT THE FISHERMEN AND OTHER RIVER USERS GET

Reasonable use of streams across private lands, when such streams meet or exceed the size threshold set by the bill.

• WHAT EVERYONE GETS 

A simple stream access law that everyone can understand.

Settlement of a divisive controversy.

Dismissal of two major lawsuits – no public trust doctrine case to be decided by the courts.

Access to public resources commensurate with Utah’s promotion of itself as a State that values and promotes outdoor recreational opportunities for members of the public.

Access from public right of ways.

Enforcement of existing trespass laws.
